LEGAL
NEGLIGENT
MISREPRESENTATION CASE ON LEAD ISSUE TO PROCEED
A listing broker who failed to disclose the presence of lead-based
paint in a house that sold
must defend against negligent misrepresentation allegations by the buyer, the U.S. District Court,
Northern District of Illinois, has ruled. The broker argued he didn't know of the lead-based paint and so
it didn't
constitute a defect requiring disclosure. But the court said that the broker had a duty under
state law to disclose latent defects that it knew about or should have known about, and the presence
of lead-based paint was a latent defect that arguably the broker could be expected to know
about. To read a summary of
this case in the Letter of the Law, NAR's online legal newsletter, Go To:

MLS ISSUES
New Subscription Fee for MLS Service
In February, all licensees will be receiving an invoice for MLS service. The invoice will
be $105.00 quarterly,
beginning in February for the 1st quarter of service. Subsequent billings for 2003 will occur in April, June,
September, and again in December for the 1st quarter of 2004. Beginning with the June billing, any agents
not paid prior to the start of a quarter will lose access to the system. Please keep in mind that you will not
be paying this subscription fee in addition to the old participation fees, but in place of them. Secretaries and
unlicensed personal assistants will not be billed.

1. To post an original message to the list, address it to:
NKmlsTalk@InternetCrusade.com -Please include a short descriptive title in the Subject field,
so others can quickly determine what the posting will cover.
2. To reply or comment to another posting you can hit your Reply feature (or similar command on
your E-mail manager) in which case your post will be automatically addressed back to the list, keeping
the same title in the Subject field. When you use the Reply feature, some software will re-quote the entire
message so please edit/delete all but a few key portions of the original message – please check this before
you hit SEND. Also, please do not send messages in html format – go to your e-mail software settings and disable
html format (use plain text or rich fine text instead); also disable your v-card if you use one – these tend to
cause coding symbols in printing your messages in the list serv.
3. Please be considerate of other list members and keep your posts as concise as possible.
Paragraph breaks make the message easier to read. TOO MANY 'CAPS' IS CONSIDERED SHOUTING!!!
