LEGISLATIVE ISSUES

House Passes Realtor Bill 90-1

Senate set to act on HB 324

The House passed legislation yesterday supported by KAR that gives Realtors clear direction on certain disclosure issues.  HB 324  <http://www.lrc.state.ky.us/record/03rs/HB324.htm> passed 90-1 and plainly states that real estate licensees do not need to disclose to buyers that someone was murdered in the house, sexually assaulted, committed suicide, a felony occurred or that a convicted sex offender lives within a block of the property.  If directly questioned by a buyer about any of the preceding, and the agent has prior knowledge of the issue, then he/she must disclose.

HB 324 now moves to the Senate where it is expected to pass as long as Realtors keep the calls coming.

"KAR members were instrumental in helping pass 324 in the House," John Chandler, KAR president, said.  "Our members need to keep the pressure on to pass HB 324 with so few days remaining in the session."

Call your state senator and tell him/her to vote yes on HB 324.  If you don't know who your senator is, click herehttp://www.lrc.state.ky.us/whoswho/2003cnty.htm

MLS ISSUES

What is the difference between a cancelled listing and a withdrawn listing?

A cancelled listing is a listing that is no longer with the the Listing Company.  These listings are available to call on and list by another Company.

A withdrawn listing is a listing that is temporarily off the market for some reason or other.  The listing is still under Contract with the existing Company and should not be called on to list.
